Eccly Author is a comprehensive digital book publishing and distribution platform that empowers independent authors to:

• Upload, publish, and distribute digital books worldwide
• Maintain complete control over pricing and access
• Connect directly with readers through our platform
• Receive industry-leading revenue shares (95-97%)
• Access comprehensive analytics and reader insights

Account Creation Requirements

• You must be at least 18 years old or have parental consent
• Provide accurate, current, and complete information
• Maintain one account per person or entity
• Verify your email address during registration

Account Security & Responsibilities

• You are responsible for maintaining account security and confidentiality
• Notify us immediately of any unauthorized access or security breaches
• You are liable for all activities conducted under your account
• We reserve the right to suspend or terminate accounts that violate these terms

Content Ownership & Rights

• You retain all rights, title, and interest in your original content
• You grant Eccly Author a non-exclusive license to distribute your content
• You warrant that you own or have rights to all uploaded content
• You are responsible for obtaining necessary permissions for third-party content

Content Guidelines

The following content is prohibited on our platform:

• Illegal, harmful, threatening, or offensive material
• Content that infringes copyright, trademark, or other intellectual property rights
• Spam, misleading information, or deceptive practices
• Adult content without proper age verification and warnings
• Content promoting violence, discrimination, or illegal activities

Revenue & Payments

• Revenue share: 95% for individual sales, 97% for bulk sales over $1000/month
• Payments processed securely through Stripe with industry-standard fees
• Authors are responsible for their own tax obligations and reporting
• We may hold payments temporarily for security, fraud prevention, or legal reasons
• Minimum payout threshold: $50 (can be adjusted upon request)

Purchasing & Access

• All sales include our 7-day satisfaction guarantee
• Access to purchased content is governed by individual author settings
• You receive a perpetual license to access purchased content
• Content may not be shared, redistributed, or resold without author permission
• Download and offline access depends on author preferences

Acceptable Use

• Respect author intellectual property and access controls
• Do not attempt to circumvent security measures or access controls
• No automated tools, bots, or scrapers to access content
• Do not reverse engineer or attempt to extract source files
• Report any technical issues or security vulnerabilities responsibly

The Eccly Author platform, including its design, features, functionality, code, and branding, is owned by Eccly Author Inc. and protected by copyright, trademark, and other intellectual property laws.

While authors retain rights to their content, the platform itself and its underlying technology remain our intellectual property. Users may not copy, modify, distribute, or create derivative works of our platform without explicit written permission.

Your privacy is fundamental to our service. We are committed to protecting your personal information and complying with all applicable privacy laws, including GDPR, CCPA, and other regional privacy regulations.

Service Availability

• We strive for 99.9% uptime but cannot guarantee uninterrupted service
• Scheduled maintenance may temporarily affect platform availability
• We are not responsible for third-party service interruptions (payment processors, CDNs, etc.)
• Force majeure events may impact service delivery

Content Disclaimer

• Authors are solely responsible for the content they publish
• We do not review all content before publication (except for reported violations)
• We do not endorse any particular author, content, or viewpoint
• User-generated content does not reflect Eccly Author's opinions or values

To the maximum extent permitted by law, Eccly Author shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or business opportunities
• Loss of data, content, or intellectual property
• Business interruption or loss of goodwill
• Third-party claims or actions

Our total liability for any claims arising from your use of Eccly Author shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100, whichever is greater.

Termination by You

• You may terminate your account at any time through your account settings
• Termination does not affect existing payment obligations or reader access to purchased content
• Published content remains accessible to existing readers for 30 days post-termination
• You may request complete content removal upon termination

Termination by Eccly Author

• We may terminate accounts for violations of these terms
• Suspension may occur for security, legal, or fraud prevention reasons
• We will provide reasonable notice when possible, except in cases of severe violations
• You will have opportunity to address violations before permanent termination when applicable

We encourage users to contact us directly to resolve any disputes. If direct resolution is not possible, disputes will be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association.

These terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any arbitration will be conducted in San Francisco, California.
